Who is the Coldest Voting Contest Official Rules

By submitting one or more votes to the "Who is the Coldest", you agree to the following rules and terms:

PROGRAM DESCRIPTION / ELIGIBILITY
NO PURCHASE NECESSARY. A purchase of a product or service from GayCities or any of its affiliated companies will not improve the chance of winning. Participation requires Internet access.

This "Who is the Coldest" sweepstakes is open only to registered members of GayCities who are at least 21 years old who are signed in and vote in the "Who is the Coldest" competition and reside in California, Ohio or Texas at time of entry. Void where prohibited by law or regulation. All federal, state and local laws and regulations apply. Employees, directors, officers, and agents of GayCities (“Sponsor”), their parent companies, divisions, dealers, affiliates, subsidiaries, distributors, advertising and promotional agencies, and suppliers involved in the Sweepstakes, as well as the members of each of their immediate families (spouse, parents, children, siblings, and in-laws) and persons residing in the same household of such individuals are not eligible to enter or win. Employees MillerCoors or employees of alcohol beverage retailers and distributors are also not eligible to enter or win.

PROMOTION PERIOD
The promotion begins on or around July 30, 2012 and ends on October, 16, 2012 at 11:59pm PDT ("Entry Period"). Grand Prize winner will be announced on 11/30/12. Category Voting Periods: See chart below. All votes must be received prior to each end dates.

HOW TO ENTER
Eligible Voters will be automatically entered into a random draw sweepstakes when they are both a signed-in GayCities registered member and participate in the "Who is the Coldest" competition by casting at least one vote in any of the five categories. After the voting period is closed for each category, the nominee receiving the most votes in each category will highlighted on the website and will have the bragging rights within the particular market area. Approximately 7 days after close of competition, one potential grand prize winner will be selected in a random drawing from all eligible entries received during the entry period. No responsibility is assumed by GayCities or advertiser for mistaken or misdirected entries or any computer, online technical malfunctions that may occur. Participants assume all risk of lost, late, misdirected, incomplete or illegible entries. Submitting a vote constitutes agreeing to the terms of these Official Rules and the grand prize winner must abide by any rules, conditions or limitations of GayCities. Limit one entry per category per day per e-mail. If more than one (1) entry per category is received from the same person or email address per day, only the first entry received will be considered valid and Sponsor may choose to disqualify all entries submitted by that person at Sponsor’s sole discretion.

PRIZING AND TERMS
GRAND PRIZE (1): MillerCoors will donate $10,000 to one charity selected by the grand prize winner. MillerCoors (advertiser) will provide a list of approved charities for winner to select from. The list may change without notice and if MillerCoors is unable to donate to the selected charity for any reason, the winner may be asked to pick an alternate charity. Other restrictions apply. Odds of winning will depend on the number of eligible entries received. No substitution, transfer, or assignment of prize permitted, except that GayCities reserves the right to substitute a prize of equivalent value in the event the offered prize becomes unavailable. GayCities and its advertisers hereby disclaim that prize cannot be assigned, transferred, exchanged or redeemed for cash. GAYCITIES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND REGARDING ALL PRIZES AND THE CONTEST, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

RIGHTS AND PERMISSIONS
Any submission can be disqualified if it EITHER subjects the submitter or the GayCities to legal jeopardy or compromises GayCities's intellectual property or trade secret interests. This includes words or imagery. Any submission that prompts a legal challenge for any cause will be disqualified. Any physical or monetary prize awarded in connection with such a submission must be returned to GayCities at your expense. Any submission can be disqualified if GayCities, in its sole discretion, determines that the entry appears to be generated via scripts or automated submission.

GENERAL CONDITIONS
GayCities will notify the potential winner by email to the address provided during entry within seven day of close of the voting period. A potential winner must respond to their e-mail notifications within 7 days of receipt, or be disqualified. All follow-up documentation must be completed, notarized, returned, and received by GayCities at the address provided, within 7 days of the date mailed to the potential winner. If the completed documentation is not received within those 7 days, potential prize winner will be disqualified and GayCities will select the charity. Entering an incorrect or incomplete e-mail address in the registration process, or failing to meet the eligibility requirements above, will result in contest disqualification. By accepting any prize, winner grants GayCities and its advertisers the right to use his/her entry, name, likeness and biographical information in any and all media for advertising/promotional purposes without further review or compensation and any such information will not be returned. GayCities reserves the right to crop any entry in whole or in part or request contest entrants to do so, in order to be viewable online. Entrants agree to the release of their name, address, and e-mail information to GayCities and its sponsors for posting and winner notification purposes, only; otherwise, please review this site's privacy policy for more information on how we use any personal data we collect from you.

PUBLICITY CONSENT. By submitting an entry or accepting a prize, where permitted by law, each winner grants to GayCities (and agrees to confirm that grant in writing) and those acting pursuant to the authority of GayCities the irrevocable right without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web, in perpetuity and throughout the universe, his/her entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the contest, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

INTERNET If for any reason the online sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of GayCities that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, GayCities reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the sweepstakes. GayCities assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, or destruction or unauthorized access to, or alteration of, entries. GayCities is not responsible for any problems or technical malfunction of any computer online systems, servers or providers, computer equipment, or software, or for failure of vote or member registration received by GayCities on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this sweepstakes. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE "WHO IS THE COLDEST" COMPETITON IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, GAYCITIES RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

ELECTRONIC MAIL MESSAGES
Voters agree to receive electronic mail messages from GayCities, which may consist of transactional/relationship and/or commercial electronic mail messages, as defined in the Federal CAN-SPAM Act of 2003. Pursuant to that act, you may request not to receive further commercial electronic mail messages from us by following the "unsubscribe" instructions included in such messages. However, you explicitly waive any rights you may have to seek actual or statutory damages for the receipt of such messages, whether authorized in the CAN-SPAM Act or under any other federal, state, or local law.

WARRANTIES Voters warrant that your submission complies with these rules and terms. Any submission that, in GayCities sole discretion violates any rule or term will be disqualified. Any physical or monetary prize awarded in connection with such a submission must be returned to GayCities at your expense. You warrant that your name and contact information, as provided by you in the entry form, are accurate and complete; and that this competition, and your participation therein, are legal in any and all jurisdictions to which you are subject. GayCities provides this web site and all associated services without warranty of any kind. You are responsible for ensuring that your entry is properly submitted.

LIMITATION OF LIABILITY
GayCities, its sponsors and advertisers are not responsible for late, lost, stolen, misdirected, damaged, incomplete, or illegible entries; or entries that are lost due to computer, Internet, or electronic malfunction. GayCities reserves the right to cancel or modify contest and award the prize through an alternate means if fraud or technical failure compromises the integrity of the contest, as determined by GayCities in its sole discretion. Entrants agree that GayCities, its sponsors, its promotion partners, related companies, agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this contest or acceptance of or use or misuse of a prize or parts thereof, including without limitation any injury, losses, damages or costs of any kind resulting from any travel and/or accommodations provided by any sponsor or in connection with any prize. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered.

INDEMNIFICATION
You agree to defend, indemnify and hold GayCities and their owners, managers, employees, agents, advertisers and affiliates harmless against any claims, damages or liability arising from your use of this web site, your participation in the contest, or your compliance with or breach of these terms, including, but not limited to all claims for copyright infringement; model, property, or trademark infringement; or any other cause related to your submission, including but not limited to actual damages, statutory damages, punitive damages, and attorneys' fees and costs.

This site contains user submitted content, comments and opinions and is for informational and entertainment purposes only. GAYCITIES MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH REGARDS TO THIS CONTENT. All postings and use of the content on this site are subject to the Terms of Use and Privacy Policy of the site.

WINNER LIST
For the name of the Grand prize winner, send a self-addressed, stamped envelope no later than January 7,2013 to: "Who is the Coldest", GayCities Inc, 584 Castro Street #623, San Francisco, CA 94114. Please do not send entries or other correspondence to this address.

GENERAL INFORMATION
These Rules & Terms, together with the sites terms of use and privacy policy constitute the entire agreement between you and GayCities, superseding any prior agreements between you and GayCities. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. These Rules & Terms and the relationship between you and GayCities shall be governed by the laws of the State of California without regard to its conflict of law provisions. You and GayCities agree to submit to the personal and exclusive jurisdiction of the courts located within the county of San Francisco, California. The failure of GayCities to exercise or enforce any right or provision of the Rules & Terms shall not constitute a waiver of such right or provision. If any provision of the Rules & Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Rules & Terms remain in full force and effect. The section titles in the Rules & Terms are for convenience only and have no legal or contractual effect.

RESERVATION OF RIGHTS
GayCities reserves the right to change these rules and terms, or to discontinue the sweepstakes, at any time and without notice.
